These Terms of Service (“Terms”) govern your use of the services, website, communications, and programs provided by The Music Garden LLC (“Company,” “we,” “our,” or “us”). By enrolling in music lessons, using our website, submitting a form, or opting into SMS/text messages, you agree to these Terms.
If you do not agree, please do not use our services.
2. Services Provided

Private music lessons
Group classes
Recitals, performances, and special events
Student progress evaluations
Online scheduling and communication tools
SMS/text reminders, announcements, and updates
We reserve the right to modify, suspend, or discontinue any service at any time.
3. SMS/Text Message Terms
By submitting your phone number or opting into text messages, you consent to receive SMS/MMS messages from The Music Garden LLC Message frequency may vary.
Opt-In Disclosure
By providing your phone number, you consent to receive recurring automated and non-automated text messages from The Music Garden LLC Consent is not a condition of purchase.
Opt-Out Instructions
You may opt out at any time by replying STOP.

4. Payment & Billing
Lesson Fees
Payment is required to reserve lesson times. Fees may be billed monthly, per session, or as part of a lesson package. Pricing is subject to change with reasonable notice.
Late or Failed Payments
Lessons may be paused if payment is declined or overdue.
Refund Policy
Unless otherwise stated in writing, lesson fees are non-refundable.
Make-up lessons may be offered based on Academy policy.
5. Scheduling, Attendance & Make-Up Lessons
Students and parents agree to follow Academy scheduling guidelines:
Advance notice is required for cancellations or rescheduling.
Repeated missed lessons may result in loss of reserved lesson time.
Teacher assignments may change as needed.
Weather or emergency closures may result in virtual lessons or rescheduling.
6. Student Safety & Conduct
To maintain a safe and respectful environment:
Students must behave appropriately at all times.
Parents/guardians must supervise minors unless otherwise approved.
The Academy reserves the right to remove students for unsafe or disruptive behavior.
7. Parental/Guardian Responsibility
For students under 18 years of age:
Parents/guardians are responsible for scheduling, communication, and billing.
Parents consent to student participation in lessons, recitals, and events.
Parents authorize emergency medical care if they cannot be reached.
8. Photo, Video & Media Release
Unless opted out in writing:
The Music Garden LLC may use photos or videos from lessons, recitals, or events for promotional purposes. Student names will not be published without consent.
9. Website Use & Intellectual Property
All website content, curriculum materials, images, videos, branding, and instructional materials are the property of The Music Garden LLC. You may not reproduce, distribute, or use any materials without written permission.
10. Prohibited Activities
You agree not to:
Use Academy systems for unlawful purposes
Interfere with website or SMS operations
Use automated tools without authorization
Harass staff, teachers, or students
Violations may result in immediate termination of services.
11. Limitation of Liability
To the fullest extent permitted by law:
The Music Garden LLC is not liable for injuries, losses, or damages arising from participation in lessons or events. Parents assume responsibility for supervising minors.
Services are provided “as is” without warranties.
12. Indemnification
You agree to indemnify and hold harmless The Music Garden LLC, its instructors, staff, and affiliates from any claims arising from:
Misuse of Academy services
Violations of these Terms
Participation in Academy activities
13. Termination
We may suspend or terminate services if:
Payments are delinquent
Policies or safety rules are violated
Communications become abusive
SMS compliance rules are violated
Enrollment termination is subject to Academy cancellation policies.
14. Changes to Terms
We may update these Terms at any time. Updates will be posted with a revised “Last Updated” date. Continued use of services constitutes acceptance of the updated Terms.
